NOTICE OF THE DATES OF THE CLOSED SEASON FOR THE COMMERCIAL BLACKLIP ABALONE FISHERY AND NOTICE OF ABALONE FISHERY CLOSURE TO SPECIFIC ACTIVITIES

I, Dr Ian Dutton, General Manager (Marine Resources) in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister for Primary Industries and Water, hereby determine under rule 9 of the Fisheries (Abalone) Rules 2017 (the Rules):

  1. That the dates of the closed season for that part of the commercial blacklip abalone fishery specified in schedule 1 are from 12:01 am 1 January 2024 to 11:59 pm 30 June 2024; and
  2. That the part of the abalone fishery specified in schedule 1 is closed to, or in respect of, the activities specified in schedule 2.

SCHEDULE 1

All that part of the commercial blacklip abalone fishery in State waters off the north-east coast of Tasmania within an area bounded in the west by an imaginary line beginning where the line of longitude 147° 47’ 01.46” East meets the high-water mark of the north coast of the mainland of Tasmania at Tomahawk Beach, then running due north until its junction with the line of latitude 40° 39’ South, then due east along that line of latitude to the outer limit of State waters, and bounded in the east by an imaginary line from the northern side of the mouth of the Great Musselroe River at Musselroe Bay running due west for 100 metres, then following the shoreline 100 metres from shore to the northernmost tip of Musselroe Point, then running due north until intersection with the line of latitude 40°48' 00" South, and running due east to the outer limit of State waters.

SCHEDULE 2

While on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) the holder of a fishing licence (abalone dive) must not enter the water by swimming or diving.

All coordinates of latitude and longitude specified in this notice are to be determined by reference to the Geocentric Datum of Australia (also known as "the GDA" or "GDA94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995.

Any expression used in this notice having a particular meaning under the Living Marine Resources Management Act 1995 (the Act) or the Rules has the same meaning in this notice.

The commercial blacklip abalone fishery in State waters off the north-east coast of Tasmania is being closed from 12:01 am 1 January 2024 to 11:59 pm 30 June 2024 as part of arrangements to control the total amount of blacklip abalone harvested in this area in the interest of resource sustainability. This closed area relates to commercial blacklip abalone fishing in fishing sub-blocks 31B, 39A and 39B only.
