NOTICE OF THE REVOCATION AND DETERMINATION OF DATES OF THE CLOSED SEASON FOR A PART OF THE SCALEFISH FISHERY FOR SAND FLATHEAD

I, David Midson, General Manager (Marine Resources) in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister administering the Living Marine Resources Management Act (1995) (the Act) and acting pursuant to section 22 of the Acts Interpretation Act 1931 hereby revoke my determination relating to closing part of the sand flathead fishery made by published notice on the 14th Day of October 2024, with effect from 11:59 PM 20 November 2024.

Further, acting pursuant to a delegation from the Minister, hereby determine under rule 11 of the Fisheries (Scalefish) Rules 2015 (the Rules) that the dates of the closed season for the scalefish fishery specified in schedule 1 are from 12:01 am 21 November 2024 to 11:59 pm 31 October 2026.

SCHEDULE 1

All that part of the non-commercial scalefish fishery for sand flathead in the EASTERN ZONE and the SOUTHERN SAND FLATHEAD REGION.

In this notice:

The EASTERN ZONE is defined as State waters on the East Coast between Cape Naturaliste to Whale Head excluding the Southern Sand Flathead Region.

The SOUTHERN SAND FLATHEAD REGION as defined in the Rules refers to the waters of the River Derwent, D’Entrecasteaux Channel, Frederick Henry Bay and Norfolk Bay.

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice.

This notice has the effect of closing the non-commercial sand flathead fishery in the Eastern Zone and the Southern Sand Flathead Region until the expiry of the scalefish management on 31 October 2026 when new management arrangements are put in place. An associated Instrument facilitates conditional access and transiting to the area for non-commercial fishers. The Closure Notice and Instrument of Exemption have the combined effect of reflecting the proposed intention of the 2023 Scalefish Review by applying a combined daily bag limit of five sand flathead per fisher in the combined area of the Eastern Zone and Southern Sand Flathead Region of which only two can be taken from the Southern Sand Flathead Region.
