Section 11

INSTRUMENT OF EXEMPTION

l, DEIDRE WILSON, being and as the Deputy Secretary (Position Number 702786) in the Department of Natural Resources and Environment, as delegate of the Minister for Primary Industries and Water and acting pursuant to section 11 of the Living Marine Resources Management Act 1995 (the Act), hereby exempt the class of persons described in Schedule 1 of this instrument from 4(a) of the Elephant Rock Fisheries (Research Area) Order 2009 and from 4(a) of the North Bay (Research Area) Order 2009 (“the Order's"), subject to the conditions provided in Schedule 2.

Any expression used in Schedule 1 or Schedule 2 bearing a particular meaning under the Act or the Order's has the same meaning in the Schedule as it has in the Act or the Order's.

This exemption takes effect on the date of signing and remains in force until 31 March 2025 or until the exemption is revoked, whichever first occurs.

SCHEDULE 1

Class of Persons

Holders or supervisors of a fishing licence (commercial dive).

SCHEDULE 2

Conditions

This exemption applies only in circumstances where the holder or supervisor of a fishing licence listed in schedule 1 undertakes a fishing trip for commercial dive purposes in the State waters referred to in part 3 of the Order's. In these circumstances, the holder or supervisor of the fishing licence listed in schedule 1 may take and possess the long-spined sea urchin, Centrostephanus rodgersii, by diving or swimming beneath the surface.

  1. The holder or supervisor of a fishing licence listed in schedule 1 must only take or be in possession of the long-spined sea urchin, Centrostephanus rodgersii, during the fishing trip.
  2. The holder or supervisor of a fishing licence listed in schedule 1 must not take or be in possession of any species other than the long-spined sea urchin, Centrostephanus rodgersii,during the fishing trip.
