Section 11

INSTRUMENT OF EXEMPTION

I, DEIDRE WILSON, being and as the Deputy Secretary (Position Number 702786) in the Department of Primary Industries, Parks, Water and Environment, as delegate of the Minister for Primary Industries and Water and acting pursuant to section 11 of the Act, hereby exempt the class of persons described in Schedule 1 of this instrument from rules 42(3), 43(3), 44(1), and 44(2) of the Fisheries (Scalefish) Rules 2015 ("the Rules"), subject to the conditions provided in Schedule 2.

Any expression used in Schedule 1 bearing a particular meaning under the Act or the Rules has the same meaning in the Schedule as it has in the Act or the Rules.

This exemption takes effect on the date of signing and remains in force until 31 December 2024 or until the exemption is revoked, whichever first occurs.

SCHEDULE 1

Class of Persons

Holders or supervisors of a fishing licence (scalefish A), fishing licence (scalefish B), fishing licence (scalefish C) and fishing licence (rock lobster).

SCHEDULE 2

Conditions

This exemption applies only in circumstances where the holder or supervisor of a fishing licence listed in schedule 1 undertakes a fishing trip on a fishing vessel during which he or she possesses more than 5 squid jigs. In these circumstances, the holder or supervisor of the fishing licence listed in schedule 1 may possess more than 5 squid jigs, subject to the following conditions:

  1. The holder or supervisor of a fishing licence listed in schedule 1 does not attach to lines more than 5 squid jigs at any one time.
  2. The holder or supervisor of a fishing licence listed in schedule 1 does not use more than 5 squid jigs at any one time.
