NOTICE OF THE REVOCATION AND DETERMINATION OF DATES OF THE CLOSED SEASON FOR A PART OF THE COMMERCIAL DIVE FISHERY

AND

NOTICE OF THE REVOCATION AND DETERMINATION OF COMMERCIAL DIVE FISHERY CLOSURE TO SPECIFIC ACTIVITIES

I, Dr David Midson, General Manager (Marine Resources) in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister administering the Living Marine Resources Management Act 1995 (the Act) and acting pursuant to section 22 of the Acts Interpretation Act 1931 hereby revoke my determinations relating to closing part of the Commercial Dive fishery including to specific activities made by published notices under rule 12 of the Fisheries (Commercial Dive) Rules 2021 on 13 November 2025 (‘determination for sub-blocks 14B and 14C’) and on 3 October 2025 (‘determination for block 15’), with effect from 11:59 pm 14 May 2026.

Further, acting pursuant to a delegation from the Minister administering the Living Marine Resources Management Act 1995 (the Act), I hereby determine under rule 12 of the Fisheries (Commercial Dive) Rules 2021 (the Rules):

  1. That the dates of the closed season for those parts of the commercial dive fishery specified in schedule 1 are from 12:01 am 15 May 2026 until further notice; and
  2. That the parts of the commercial dive fishery specified in schedule 1 are closed to, or in respect of, the activities specified in schedule 2.

SCHEDULE 1

All that part of the commercial dive fishery in State waters in the D’Entrecasteaux Channel and Port Esperance region within an area bounded by an imaginary line starting from the high-water mark closest to Piersons Point at the point of latitude 43°03’12”S and longitude 147°20’28”E, then following the line of high water generally south to the high-water mark of Blubber Head at latitude 43°19’35.9”S and longitude 147°04’19.8”E then following the line of high-water generally south-west to the high-water mark at Burnett Point, then running directly to the high-water mark of Hopwood Point at latitude 43°25’10.1”S and longitude 147°05’31.7”E, then following the line of high-water generally north-east to Mays Creek at the point of latitude 43°19’46”S and longitude 147°14’21”E, then following the line of high water generally north to the high-water mark closest to the point of latitude 43°04’02.6S and longitude 147°20’59.4”E at Boulder Point, then running directly to the high-water mark at the point of commencement.

SCHEDULE 2

While on a commercial fishing trip in State waters for the purpose of taking periwinkles (species Lunella undulata) the holder of a fishing licence (commercial dive) must not enter the water by swimming or diving.

In this notice:

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice.

All coordinates of latitude and longitude specified in this notice are to be determined by reference to the Geocentric Datum of Australia (also known as "the GDA" or "GDA94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995.

This notice has the effect of revoking the determinations closing the commercial dive fishery to the take of urchins and periwinkles in the Port Esperance area of the South-Eastern fishery part, inclusive of subblocks 14B and 14C, and the determination closing the commercial dive fishery to the take of urchins and periwinkles in the D’Entrecasteaux Channel area of the South-Eastern fishery part, inclusive of block 15, and replacing them with a new notice closing sub-blocks 14B, 14C, and block 15 to the take of Periwinkles only, effective from 14 May 2026.
