FISHERIES (ROCK LOBSTER) RULES 2022
Notice – Non-commercial fishing report
I, Dr David Midson, General Manager - Marine Resources in the Department of Natural Resources and Environment Tasmania (the Department), acting pursuant to a delegation from the Secretary and acting in accordance with rule 108 of the Fisheries (Rock Lobster) Rules 2022 (the Rules), hereby revoke the determination made pursuant to rule 108 of the Rules in the Notice – Non-Commercial Fishing Report, dated 6 October 2023 and published in the Gazette on 11 October 2023 with immediate effect, and I further hereby determine that from 00:01 hours on Friday 1 November 2024 holders of recreational fishing licences are to report to the Secretary the details of rock lobster taken, or rock lobster fishing undertaken as specified in the schedules 1-3 to this notice:
Schedule 1
- The details to be included in the report by the holder of a recreational fishing licence (the fisher) are a catch report which records;
- The date that the fishing was undertaken;
- The fishing method used to take the rock lobster;
- The general location where fishing occurred;
- How many rock lobsters were kept (even if 0); and
- How many rock lobsters were released (even if 0).
Schedule 2
- The circumstances in which the report is to be made is:
- Immediately after the last rock lobster is brought to the boat during a non-commercial fishing trip and marked as required by rule 34 of the Rules and within 250 metres from where the rock lobster was marked; and before landing any lobster; or
- In the case of fishing from the shore, immediately after the last rock lobster is landed and marked as required by rule 34 of the Rules, or in the case where no rock lobster are taken, immediately after the last rock lobster pot or rock lobster ring is hauled and within 250 metres of landing; or
- In the case where no rock lobster are taken, within 250 metres of completing diving for rock lobster, or the last rock lobster pot or rock lobster ring was hauled.
Schedule 3
- The method by which the report is to be made is;
- By the holder of a recreational fishing licence making their own report using the Fishing Tas App or by having a report completed on their behalf using the Fishing Tas App; provided that
- to report catch on behalf of someone else, a non-commercial fisher must be 18 years of age or above; and
- is responsible for ensuring that all the provided information is true and correct; or
- By using the reporting service approved under rule 98 of the Rules.
- By the holder of a recreational fishing licence making their own report using the Fishing Tas App or by having a report completed on their behalf using the Fishing Tas App; provided that
A report is made when it is received by the server-side database held and maintained by the Department or when the reporting service approved under rule 98 of the Rules receives the report or where a person can establish that they have submitted the report using the Fishing Tas App.
If a person is unable to make the report due to circumstances beyond their control, the person may record in writing the details as set out schedule 1(1) and make the report in accordance with schedule 3(1)(a) or 3(1)(b) at the first reasonable opportunity to do so.
In this notice:
Boat includes vessel.
Fishing Tas App means the software application that leverages the capabilities of iPhone (iOS) and Android smartphone or tablet devices to enable users to make fishing reports required by this notice, via a secure Web Service or API to the server-side database held and maintained by the Department.
Unless otherwise defined in this notice, words and expressions used in this notice have the same meaning as in the Living Marine Resources Management Act 1995 and the Fisheries (Rock Lobster) Rules 2022.
