INSTRUMENT OF EXEMPTION
I, Jason Jacobi, Secretary in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister administering the Living Marine Resources Management Act 1995 (the Act), and acting pursuant to section 11 of the Act, hereby exempt the class of persons specified in Schedule 1 from complying with the determination made by Dr David Midson on 14 October 2024 by the Notice That Part of the Scalefish Fishery is Closed to or in Respect of Specific Activities (the Closure Notice) made pursuant to rule 11 of the Fisheries (Scalefish) Rules 2015 (the Rules), on the condition specified in Schedule 2.
This exemption takes effect from 12:01 am on 1 November 2024 and remains in force until 11:59 pm on 31 October 2026.

Class of Persons
- Persons who are fishing for non-commercial purposes.
SCHEDULE 2
Condition
- A person may possess a gillnet on a vessel on Macquarie Harbour eastwards of an imaginary line between Sophia Point (145°20'46"E 42°12'25"S) and Liberty Point (145°19'03"E 42°17'07"S) for the purpose of using the gillnet to fish in waters outside Macquarie Harbour.
Any expression used in this instrument bearing a particular meaning under the Act or the Rules has the same meaning as it has in the Act or the Rules.
All coordinates of latitude and longitude specified in this notice are to be determined by reference to the Geocentric Datum of Australia (also known as "the GDA" or "GDA94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995.
