Fisheries (Commercial Dive) Rules 2021

NOTICE OF THE DATES OF THE CLOSED SEASON FOR THE COMMERCIAL DIVE FISHERY AND NOTICE OF COMMERCIAL DIVE FISHERY CLOSURE TO SPECIFIC ACTIVITIES

I, Dr David Midson, General Manager (Marine Resources) in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister administering the Living Marine Resources Management Act 1995 (the Act), hereby determine under rule 12 of the Fisheries (Commercial Dive) Rules 2021 (the Rules):

  1. That the dates of the closed season for those parts of the commercial dive fishery specified in schedule 1 are from 12:01 am 7 November 2025 until further notice; and
  2. That the parts of the commercial dive fishery specified in schedule 1 are closed to, or in respect of, the activities specified in schedule 2.

SCHEDULE 1

All that part of the Commercial Dive fishery in the State waters off the south-east of Tasmania enclosed by an imaginary line commencing at the high-water mark of Blubber Head at latitude 43°19’35.9” South longitude 147°04’19.8” East, then running due east to the point of latitude 43°19’45.9” South, longitude 147°14’20.8” East near the mouth of Mays Creek, then following the line of high-water generally south-west to the high-water mark of Hopewood Point at latitude 43°25’10.1” South, longitude 147°05’31.7” East, then running directly to the high-water mark at Burnett Point, then following the line of high-water generally north-east back to the point of commencement.

SCHEDULE 2

While on a commercial fishing trip in State waters for the purpose of taking controlled fish including shortspined sea urchins (species Heliocidaris erythrogramma), longspined sea urchins (species Centrostephanus rodgersii), and periwinkles (species Lunella undulata) the holder of a fishing licence (commercial dive) must not enter the water by swimming or diving.

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice.

All coordinates of latitude and longitude specified in this notice are to be determined by reference to the Geocentric Datum of Australia (also known as "the GDA" or "GDA94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995.

This notice has the effect of closing the commercial dive fishery to the take of urchins and periwinkles in the Port Esperance area of the South-Eastern fishery part, inclusive of subblocks 14B and 14C, from Friday 7th November 2025 until further notice.
