NOTICE OF THE DATES OF THE CLOSED SEASON FOR PART OF THE COMMERCIAL DIVE FISHERY AND NOTICE OF COMMERCIAL DIVE FISHERY PART CLOSURE TO SPECIFIC ACTIVITIES

I, Dr David Midson, General Manager (Marine Resources) in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister administering the Living Marine Resources Management Act 1995 (the Act), hereby determine under rule 12 of the Fisheries (Commercial Dive) Rules 2021 (the Rules):

  1. That the dates of the closed season for those parts of the commercial dive fishery specified in schedule 1 are from 12:01 am 13 May 2026 until further notice; and
  2. That the parts of the commercial dive fishery specified in schedule 1 are closed to, or in respect of, the activities specified in schedule 2.

SCHEDULE 1

All that part of the commercial dive fishery in State waters off the south-east coast of Tasmania within an area enclosed by an imaginary line running from where the line of latitude 43°04’24.17”S meets the line of high water at Outer North Head, then running due west to the line of longitude 147°34’48.68”E, then running due south to the line of latitude 43°14’09.45”S, then running due east to the line of longitude 147°43’01.64”E, then running due north to the line of high water at Salters Point, then following the line of high water in an approximately north-west direction back to the point of commencement.

SCHEDULE 2

While on a commercial fishing trip in State waters for the purpose of taking controlled fish including shortspined sea urchins (species Heliocidaris erythrogramma), longspined sea urchins (species Centrostephanus rodgersii), and periwinkles (species Lunella undulata) the holder of a fishing licence (commercial dive) must not enter the water by swimming or diving.

In this notice:

Any expression used, having a particular meaning under the Act or the Rules, has the same meaning in this notice.

All coordinates of latitude and longitude specified in this notice are to be determined by reference to the Geocentric Datum of Australia (also known as "the GDA" or "GDA94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995.

This notice has the effect of closing the commercial dive fishery to the take of urchins and periwinkles in the White Beach area of the South-Eastern fishery part, inclusive of sub-blocks 20A and 20B, from Wednesday 13 May 2026 until further notice. This is part of arrangements to manage market access risks arising from biotoxin activity.
