NOTICE OF THE DATES OF THE CLOSED SEASON FOR THE COMMERCIAL BLACKLIP ABALONE FISHERY AND NOTICE OF ABALONE FISHERY CLOSURE TO SPECIFIC ACTIVITIES

 

I, Dr Ian Dutton, Director (Marine Resources) in the Department of Primary Industries, Parks, Water and Environment, acting pursuant to a delegation from the Minister for Primary Industries and Water made on 12 November 2018 and acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 (the Act) and section 22 of the Acts Interpretation Act 1931, hereby:

Revoke the notice titled Notice - Dates Of Closure Of The Commercial Blacklip Abalone Fishery In State Waters Off Albatross Island, Off The East Coast And Off The South Coast Of Tasmania published on the website of the Department http://dpipwe.tas.gov.au/sea-fishing-aquaculture/commercial-fishing/abalone-fishery/abalone-closures on Tuesday 16 April 2019 on and from 12:01 am 22 December 2019;
 

Furthermore, I, Dr Ian Dutton, Director (Marine Resources) in the Department of Primary Industries, Parks, Water and Environment, acting pursuant to a delegation from the Minister for Primary Industries and Water made on 12 November 2018 and acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 (the Act), hereby determine under rule 9 of the Fisheries (Abalone) Rules 2017 (the Rules):

 
A.    That the dates of the closed season for those parts of the commercial blacklip abalone fishery specified in schedule 1 are from 12:01 am 22 December 2019 to 11:59 pm 31 December 2019; and

B.     That those parts of the abalone fishery specified in schedule 1 are closed to, or in respect of, the activities specified in schedule 2.

 

SCHEDULE 1

All those parts of the commercial blacklip abalone fishery in State waters:

A.    off Albatross Island enclosed in the east by the line of longitude 144o 40' 42.23" East, enclosed in the west by the line of longitude 144o 38' 03.03" East, enclosed in the north by the line of latitude 40o 21' 32.63" South, and enclosed in the south by the line of latitude 40o 23' 35.95" South; and

B.     off the east coast of Tasmania bounded in the north by the line of latitude 41° 52' 05.86" South commencing at Peggys Point and running due east to the outer limit of State waters, and bounded in the south by the line of latitude 43° 13' 18.15" South commencing at Cape Pillar and running due east to the outer limit of State waters.
 

SCHEDULE 2

While on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) the holder of a fishing licence (abalone dive) must not enter the water by swimming or diving.

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice.

The commercial blacklip abalone fishery in State waters off the south coast of Tasmania, sub-blocks 13A and 13B, is being opened to fishing on and from 12:01 am 22 December 2019. The closed areas in this notice relate to the continuation of commercial closures to fishing for blacklip abalone in State waters off Albatross Island in sub-block 49D and in certain State waters off the east coast of Tasmania to 11:59 pm 31 December 2019.​
