Notice – Revocation and dates of closing of the commercial greenlip abalone fishery in State waters off the north-east coast of Tasmania

 

Rule 9(1) of the Fisheries (Abalone) Rules 2017

 

Pursuant to the powers under the Fisheries (Abalone) Rules 2017 ("the Rules") that were delegated to the Director (Marine Resources) on 2 July 2018 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), under rule 9(1) of the Rules:

 

  1. I hereby revoke, on and from 30 July 2018, the public notice titled Revocation and dates of closing of the commercial greenlip abalone fishery in State waters off the north-east and north-west coasts of Tasmania published on the website of the Department http://dpipwe.tas.gov.au/sea-fishing-aquaculture/commercial-fishing/abalone-fishery/abalone-closures on Monday 25 June 2018;

     
  2. I also determine that the date of closing of the commercial greenlip abalone fishery in State waters off the north-east coast of Tasmania to the activities of the take of greenlip abalone (Haliotis laevigata) by the holder of a fishing licence (abalone dive) is as follows:

     

    from 30 July 2018, inclusive; and

     
  3. I also determine that, from the date stated in 2. above, the holder of a fishing licence (abalone dive) while on a commercial fishing trip in State waters for the purpose of taking greenlip abalone (Haliotis laevigata) must not enter the water, by swimming or diving, in the closed area stated in 2. above;

     

where “State waters off the north-east coast of Tasmania" is defined to mean: State waters off the north-east coast of Tasmania enclosed by an imaginary line commencing where the line of longitude 147° 47' 01.46" East meets the high watermark on mainland Tasmania at Tomahawk Beach then running due north to where it meets the line of latitude 40° 39' South, then running due east to the line of longitude 148o 33' 31.88" East, then following that line of longitude due south to the line of latitude 40o 59' 42.92" South, then running due west to the high water mark at Eddystone Point, then following the line of high water generally north-west to the point of commencement.

 

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice as it has in the Act or the Rules.

INFORMATION

The present commercial greenlip abalone fishery closure in State waters off the north-east and north-west coasts of Tasmania is being altered. Only the following sub-blocks will remain closed to commercial fishing for greenlip abalone on and from 30 July 2018: in the north-east, sub-blocks 31A, 31B, 39A and 39B.
