NOTICE - DATES OF CLOSURE OF THE COMMERCIAL BLACKLIP ABALONE FISHERY IN STATE WATERS OFF THE EAST COAST OF TASMANIA

 

Rule 9(1) of the Fisheries (Abalone) Rules 2017

 

Pursuant to the powers under the Fisheries (Abalone) Rules 2017 ("the Rules") that were delegated to the General Manager (Water and Marine Resources) on 2 July 2018 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), under rule 9(1) of the Rules:

 

1.    I determine that the dates of closure of the commercial blacklip abalone fishery in State waters off the east coast of Tasmania to the activities of the take of blacklip abalone (Haliotis rubra) by the holder of a fishing licence (abalone dive) are as follow:

 

from 21 September 2018 to 31 December 2018 inclusive; and

 

2.    I also determine that, from the date stated in 1. above, the holder of a fishing licence (abalone dive) while on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) must not enter the water, by swimming or diving, in the closed area stated in 1. above;

 

where “State waters off the east coast of Tasmania" is defined to mean: the area of State waters off the east coast of Tasmania bounded in the north by an imaginary line starting from the northern side of the mouth of the Great Musselroe River at Musselroe Bay, running due west for 100 metres, then following the shoreline 100 metres from shore to the northernmost tip of Musselroe Point, then running due north until its junction with the line of latitude 40° 48' 00" South and running due east to the outer limit of State waters, and bounded in the south by the line of latitude 43° 13' 18.15" South commencing at Cape Pillar and running due east to the outer limit of State waters.

 

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice as it has in the Act or the Rules.

Information

 

This notice has the effect of closing the commercial blacklip abalone fishery in State waters off the east coast of Tasmania from Musselroe Bay in the north to Cape Pillar in the south from 21 September 2018 to 31 December 2018 inclusive as part of arrangements to control the total amount of abalone harvested in this area in the interest of resource sustainability.
