INSTRUMENT OF EXEMPTION
I, DEIDRE WILSON, being and as the Deputy Secretary (Position Number 702786) in the Department of Natural Resources and Environment, as delegate of the Minister for Primary Industries and Water and acting pursuant to section 11 of the Act, hereby exempt the class of persons described in Schedule 1 from a Public Notice - Notice of the Dates of the Closure for Part of the Scalefish Fishery and Notice of Scalefish Fishery Closure to Specific Activities signed on 11 November 2022 to allow for activities defined in Schedule 2.
This exemption takes effect from 12:01 am on 15 November 2022 and remains in force until 11:59 pm on 14 November 2023.
SCHEDULE 1
Class of Persons
The holder or supervisor of a fishing licence (scalefish A) or fishing licence (scalefish B) that is endorsed to fish for scalefish for commercial purposes in Macquarie Harbour.
SCHEDULE 2
Conditions
1) The holder or supervisor may set or leave a gillnet from 15 April 2023 to the 14 November 2023 (inclusive).
2) The holder or supervisor must not set or leave a gillnet for a continuous period of more than two hours from one hour after sunrise to one hour before sunset.
3) The holder or supervisor may set or leave a gillnet from one hour before sunset to one hour after sunrise.
4) The holder or supervisor must make a telephone report to the reporting service at least 1 hour prior to starting a fishing trip.
5) The holder or supervisor must make a report to the Manager, Wild Fisheries Management Branch (Position Number 25827) at commercial.fisheries@nre.tas.gov.au within four hours immediately after completing a fishing trip when an interaction with Maugean Skate has resulted in mortality.
6) The holder or supervisor must accommodate an observer during a fishing trip upon request of the Manager, Wild Fisheries Management Branch (Position Number 25827).
7) The holder or supervisor may set or leave a gillnet in the waters of Macquarie Harbour outside the imaginary boundaries defined by joining the following points in the order in which they are listed below:
a) an imaginary straight line from Dead Horse Point to King Point;
b) an imaginary line that follows the high water mark in an approximately south-east direction from King Point to Connellys Point;
c) an imaginary straight line from Connellys Point to Sophia Point;
d) an imaginary straight line from Sophia Point to Gould Point, bisecting Philips Island;
e) an imaginary straight line from Gould Point to Charcoal Burners Bluff;
f) an imaginary straight line from Charcoal Burners Bluff to Gordon Point;
g) an imaginary line that follows the high water mark in an approximately south-west direction from Gordon Point to latitude 42°26'06"S/longitude 145°27'28"E at Shamrock Point;
h) an imaginary straight line from latitude 42°26'06"S/longitude 145°27'28"E at Shamrock Point to latitude 42°26'17"S/longitude 145°26'49"E at the southernmost end of the beach below Henrietta Creek;
i) an imaginary line that follows the high water mark in an approximately north-west direction from latitude 42°26'17"S/longitude 145°26'49"E at the southernmost end of the beach below Henrietta Creek to Backagain Point;
j) an imaginary straight line from Backagain Point to latitude 42°14'44.1"S/longitude 145°17'14.7"E at the channel marker/navigation beacon;
k) an imaginary straight line from latitude 42°14'44.1"S/longitude 145°17'14.7"E to latitude 42°13'53.1"S/longitude 145°18'33.3"E at the channel marker/navigation beacon;
l) an imaginary straight line from latitude 42°13'53.1"S/longitude 145°18'33.3"E at the channel marker/navigation beacon to latitude 42°11'51"S/longitude 145°17'26.4"E on Neck Island;
m) an imaginary straight line from latitude 42°11'51"S/longitude 145°17'26.4"E on Neck Island to Buoy Point;
n) an imaginary straight line from Buoy Point to Dead Horse Point.
8) The holder or supervisor must not set or leave a gillnet in the waters of Macquarie Harbour defined as:
(a) Macquarie Harbour Entrance
(b) Birchs Narrows
(c) Lower Birchs Inlet
(d) south and east of an imaginary straight line from Gordon Point to Charcoal Burners Bluff
Any expression used in Schedule 1 bearing a particular meaning under the Act or the Rules has the same meaning in the Schedule as it has in the Act or the Rules.
