Notice - Dates of closure of the commercial greenlip abalone fishery in state waters off clarke island

 

Rule 9(1) of the Fisheries (Abalone) Rules 2017

 

Pursuant to the powers under the Fisheries (Abalone) Rules 2017 ("the Rules") that were delegated to the Director (Marine Resources) on 2 July 2018 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), under rule 9(1) of the Rules:

 

1.    I determine that the dates of closure of the commercial greenlip abalone fishery in State waters off Clarke Island to the activities of the take of greenlip abalone (Haliotis laevigata) by the holder of a fishing licence (abalone dive) are as follow:

 

from 12:01 am 31 October 2018 to 11:59 pm 31 December 2018; and

 

2.    I also determine that, during the dates of closure stated in 1. above, the holder of a fishing licence (abalone dive) while on a commercial fishing trip in State waters for the purpose of taking greenlip abalone (Haliotis laevigata) must not enter the water, by swimming or diving, in the closed area stated in 1. above;

 

where: “State waters off Clarke Island" is defined to mean: the area of State waters off Clarke Island enclosed by an imaginary line commencing at the high water mark at River Point then running due west to the line of longitude 147o 30' 48.94" East then running due south to the line of latitude 40o 38' 15.06" South then running due east to the line of longitude 148o 36' 40.69" East then running due north to the line of latitude 40o 23' 09.66" South, then running due west to high water mark at Thirsty Lagoon, then following the line of high water generally west along the north coast of Cape Barren Island back to the point of commencement.

 

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice as it has in the Act or the Rules.

Information

 

The commercial greenlip abalone fishery in State waters off Clarke Island is being closed to control the total amount of greenlip abalone harvested in this area. The closed area relates to commercial fishing for greenlip abalone in fishing blocks 32 and 33 only from 12:01 am 31 October 2018 to 11:59 pm 31 December 2018.
