Living Marine Resources Management Act 1995

 

Notice – dates of closure of the commercial blacklip abalone fishery in State waters off the west coast of Tasmania and off the south-east coast of the furneaux group of islands

 

Rule 9(1) of the Fisheries (Abalone) Rules 2017

 

Pursuant to the powers under the Fisheries (Abalone) Rules 2017 ("the Rules") that were delegated to the Director (Marine Resources) on 2 July 2018 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), under rule 9(1) of the Rules:

 

  1. I determine that the dates of closure of the commercial blacklip abalone fishery in State waters off the west coast of Tasmania and State waters off the south-east coast of the Furneaux Group of islands to the activities of the take of blacklip abalone (Haliotis rubra) by the holder of a fishing licence (abalone dive) are as follow:

     

    from 12:01 am 31 October 2018 to 11:59 pm 31 December 2018; and

     
  2. I also determine that, during the dates of closure stated in 1. above, the holder of a fishing licence (abalone dive) while on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) must not enter the water, by swimming or diving, in the closed areas stated in 1. above;

     

where “State waters off the west coast of Tasmania" is defined to mean: those State waters off the west coast of Tasmania bounded in the north by the line of latitude 42° 35' 50.66" South and bounded in the south by the line of latitude 43o 25' 43.95" South; and

 

“State waters off the south-east coast of the Furneaux Group of islands" is defined to mean: those State waters off the south-east coast of the Furneaux Group of Islands enclosed by an imaginary line commencing at the point latitude 40° 38' 02.92" South and longitude 148° 10' 49.31" East then running due north to the line of high water at South Head on Clarke Island then following the line of high water generally north-east to Seal Point then running generally east to Passage Point then following the line of high water generally east and north to Thirsty Lagoon then following the line of latitude 40° 23' 18.79" South due east to the line of longitude 148° 36' 45.39" East then running due south to the line of latitude 40° 38' 02.92" South then running due west to the point of commencement.

 

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice as it has in the Act or the Rules.

INFORMATION

The commercial blacklip abalone fishery in State waters off the west coast of Tasmania and off the south-east coast of the Furneaux Group of islands is being closed. The following blocks will close to commercial fishing for blacklip abalone from 12:01 am 31 October 2018 to 11:59 pm 31 December 2018: blocks 10, 11 and 33 only.
