Notice – Revocation and dates of closing of the commercial blacklip abalone fishery in State waters off the north-east coast of Tasmania

 

Rule 9(1) of the Fisheries (Abalone) Rules 2017

 

Pursuant to the powers under the Fisheries (Abalone) Rules 2017 ("the Rules") that were delegated to the Director (Marine Resources) on 2 July 2018 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), under rule 9(1) of the Rules:

 

  1. I hereby revoke, on and from 30 July 2018, the public notice titled Dates of closing of the commercial blacklip abalone fishery in State waters off the north-east coast of Tasmania published in Gazette number 21762 on Wednesday 20 December 2017;

     
  2. I also determine that the date of closing of the commercial blacklip abalone fishery in State waters off the north-east coast of Tasmania to the activities of the take of blacklip abalone (Haliotis rubra) by the holder of a fishing licence (abalone dive) is as follows:

     

    from 30 July 2018, inclusive; and

     
  3. I also determine that, from the date stated in 2. above, the holder of a fishing licence (abalone dive) while on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) must not enter the water, by swimming or diving, in the closed area stated in 2. above;

     

where “State waters off the north-east coast of Tasmania" is defined to mean: those State waters off the north-east coast of Tasmania within an area bounded in the west by an imaginary line beginning where the line of longitude 147° 47' 01.46" East meets the high-water mark of the north coast of the mainland of Tasmania at Tomahawk Beach, then running due north until its junction with the line of latitude 40° 39' South, then due east along that line of latitude to the limit of State waters, and bounded in the east by an imaginary line from the northern side of the mouth of the Great Musselroe River at Musselroe Bay running due west for 100 metres, then following the shoreline 100 metres from shore to the northernmost tip of Musselroe Point, then running due north until intersection with the line of latitude 40o 48' 00" South, and running due east to the outer limit of State waters.

 

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice as it has in the Act or the Rules.

INFORMATION

The present commercial blacklip abalone fishery closure in State waters off the north-east coast of Tasmania is being altered. Only the following sub-blocks will remain closed to commercial fishing for blacklip abalone on and from 30 July 2018: in the north-east, sub-blocks 31B, 39A and 39B.
