NOTICE - DATES OF CLOSURE OF THE COMMERCIAL BLACKLIP ABALONE FISHERY IN STATE WATERS OFF ALBATROSS ISLAND, OFF THE EAST COAST AND OFF THE SOUTH COAST OF TASMANIA

 

Rule 9(1) of the Fisheries (Abalone) Rules 2017

 

Pursuant to the powers under the Fisheries (Abalone) Rules 2017 ("the Rules") that were delegated to the Director (Marine Resources) on 12 November 2018 by the Minister acting pursuant to section 20(1) of the Living Marine Resources Management Act 1995 ("the Act"), under rule 9(1) of the Rules:

 

  1. I determine that the dates of closure of the commercial blacklip abalone fishery in State waters off Albatross Island, State waters off the east coast and State waters off the south coast to the activities of the take of blacklip abalone (Haliotis rubra) by the holder of a fishing licence (abalone dive) are as follow:

 

from 12:01 am 21 April 2019 to 11:59 pm 31 December 2019; and

 

2. I also determine that, during the dates of closure stated in 1. above, the holder of a fishing licence (abalone dive) while on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) must not enter the water, by swimming or diving, in the closed areas stated in 1. above;
 

where “State waters off Albatross Island" is defined to mean: the area of State waters off Albatross Island enclosed in the east by the line of longitude 144o 40' 42.23" East, enclosed in the west by the line of longitude 144o 38' 03.03" East, enclosed in the north by the line of latitude 40o 21' 32.63" South, and enclosed in the south by the line of latitude 40o 23' 35.95" South;

 

where “State waters off the east coast" is defined to mean: the area of State waters off the east coast of Tasmania bounded in the north by the line of latitude 41° 52' 05.86" South commencing at Peggys Point and running due east to the outer limit of State waters, and bounded in the south by the line of latitude 43° 13' 18.15" South commencing at Cape Pillar and running due east to the outer limit of State waters; and

 

State waters off the south coast" is defined to mean: State waters off the south coast of Tasmania bounded in the east by the line of longitude 146° 52' 15.62" East at Whale Head and bounded in the west by the line of longitude 146o 33' 38.70" East at Prion Beach.

 

Any expression used in this notice having a particular meaning under the Act or the Rules has the same meaning in this notice as it has in the Act or the Rules.

Information

 

This notice has the effect of closing the commercial blacklip abalone fishery in State waters off Albatross Island in sub-block 49D, in State waters off the east coast from Peggys Point in the north to Cape Pillar in the south, as well as in State waters off the south coast of Tasmania from Whale Head in the east to Prion Beach in the west (sub-blocks 13A and 13B) only from 12:01 am 21 April 2019 to 11:59 pm 31 December 2019 as part of arrangements to control the total amount of abalone harvested in these areas in the interest of resource sustainability.
