NOTICE OF THE DATES OF THE CLOSED SEASON FOR THE COMMERCIAL BLACKLIP ABALONE FISHERY AND NOTICE OF ABALONE FISHERY CLOSURE TO SPECIFIC ACTIVITIES
I, Dr Ian Dutton, General Manager (Marine Resources) in the Department of Natural Resources and Environment Tasmania, acting pursuant to a delegation from the Minister for Primary Industries and Water, hereby determine under rule 9 of the Fisheries (Abalone) Rules 2017 (the Rules):
A. that the dates of the closed season for those parts of the commercial blacklip abalone fishery specified in schedule 1 are from 12:01 am 28 September 2023 to 11:59 pm 31 December 2023; and
B. that the parts of the abalone fishery specified in schedule 1 are closed to, or in respect of, the activities specified in schedule 2.
SCHEDULE 1
All those parts of the commercial blacklip abalone fishery in State waters off the north-east coast of Flinders Island and the north-east coast of Cape Barren Island within an area enclosed by an imaginary line commencing at the high water mark at Pot Boil Point closest to the point of latitude 40o 12' 35.79" South, longitude 148o 19' 50.69" East then running directly to the high water mark at Puncheon Point then following the line of high water generally south-east closest to the point of latitude 40o 23' 20.09" South, longitude 148o 25' 58.69" East at Thirsty Lagoon then running due east to the line of longitude 148o 36' 45.72" East then running due north to the line of latitude 39o 35' 17.15" South then running due west to the line of longitude 148o 05' 03.95" East, then running directly to the high water mark on Foochow Beach North closest to the point of latitude 39o 45' 24.93" South, longitude 147o 58' 51.30" East, then following the line of high water generally south-east to the point of commencement.
SCHEDULE 2
While on a commercial fishing trip in State waters for the purpose of taking blacklip abalone (Haliotis rubra) the holder of a fishing licence (abalone dive) must not enter the water by swimming or diving.
All coordinates of latitude and longitude specified in this notice are to be determined by reference to the Geocentric Datum of Australia (also known as "the GDA" or "GDA94") as defined in the Commonwealth Gazette No. GN 35, 6 September 1995.
Any expression used in this notice having a particular meaning under the Living Marine Resources Management Act 1995 or the Rules has the same meaning in this notice.

The commercial blacklip abalone fishery in State waters off the north-east coast of Flinders Island and the north-east coast of Cape Barren Island is being closed. The following blocks will close to commercial fishing for blacklip abalone from 12:01 am 28 September 2023 to 11:59 pm 31 December 2023: block 36 (comprising sub-blocks 36A and 36B) and block 38 (comprising sub-blocks 38A [Babel Island], 38B and 38C) only.
